End User Agreement

This End User Agreement ('Agreement') is a legally binding contract between you ('End User' or 'you') and Rabbit regarding your use of the Spotify Platform, Spotify Service, and Spotify Content (collectively referred to as the 'Spotify Services'). By accessing or using the Spotify Services, you agree to be bound by the terms and conditions set forth in this Agreement.

Warranty Disclaimer: You acknowledge and agree that Spotify does not make any warranties or representations on behalf of the Spotify Services. Rabbit expressly disclaims all implied warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Rabbit does not guarantee the accuracy, completeness, or reliability of any information provided through the Spotify Services.

Prohibition on Modifications and Derivative Works: You shall not modify, adapt, translate, create derivative works, or make any alterations to the Spotify Services without the prior written consent of Rabbit. This includes, but is not limited to, reverse-engineering, decompiling, disassembling, or attempting to derive the source code or any underlying ideas or algorithms of the Spotify Services.

No Liability for Third Parties: You acknowledge and agree that Rabbit is not responsible for any products, services, or content provided by third parties that may be accessed or obtained through the Spotify Services. Rabbit disclaims any liability for any actions, omissions, or damages arising from your use of such third-party products, services, or content.

Spotify as Third Party Beneficiary: You acknowledge and agree that Spotify is a third-party beneficiary of this Agreement and is entitled to enforce the terms and conditions contained herein. Furthermore, Spotify has the right to directly enforce your compliance with the terms of this Agreement and Rabbit’s privacy policy.

Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of Canada. Any dispute arising out of or relating to this Agreement shall be exclusively resolved in the state or federal courts located within Canada, and you hereby consent to the personal jurisdiction and venue of such courts.

Entire Agreement: This Agreement constitutes the entire agreement between you and Rabbit regarding the subject matter herein and supersedes all prior or contemporaneous agreements, understandings, and communications, whether written or oral.

By using the Spotify Services, you confirm that you have read, understood, and agree to be bound by this End User Agreement. If you do not agree to these terms, you must refrain from accessing or using the Spotify Services.
